General Terms and Conditions of Sale
These online general terms and conditions of sale (hereinafter, the “GTC”) govern the sales contract (hereinafter, the “Contract”) for the products (hereinafter, the “product” or “products”) offered by MarcheLove – Via Ungaretti 84 – 62100 Macerata (hereinafter, “LTS”) through its website “[www.marchelove.it](http://www.marchelove.it)” (hereinafter, the “site”) to site users (hereinafter, the “customers” or the “customer”).
These general terms and conditions of sale apply exclusively to customers qualifying as “consumers” pursuant to art. 3, para. 1, letter a), of Legislative Decree No. 206 of 6 September 2005, i.e., “natural persons acting for purposes unrelated to any business or professional activity they may carry out,” and who are of legal age.
All information on the site is provided in Italian and English. The customer declares that they have read all the above information and general terms and conditions of sale before placing an order. Before ordering a product, the customer declares that the purchase of said product is not directly related to their professional activity, as it is intended for personal use. The customer also declares that they have the legal capacity to enter into obligations as provided in these general terms and conditions.
These general terms and conditions of sale govern the definition of the rights and obligations of the parties in the context of a distance sale of goods offered in the online store “MarcheLove.it.”
This version of the general terms and conditions of sale applies exclusively to sales made to consumers whose domicile or residence is in Italy or in a country of the European Union.
Any purchase order confirmed by clicking the validation button constitutes an irrevocable commitment by the customer, which can only be challenged in the cases provided for in this contract under the sections “Right of Withdrawal” and “Order Execution.”
The contract will be concluded only upon receipt of the order confirmation from MarcheLove.it within 24/48 hours of the purchase order. The customer will receive an email notification confirming the order with all the contract elements (including the products ordered, prices, delivery dates, and shipping costs).
MarcheLove.it reserves the right not to confirm an order for any reason, in particular due to product supply issues or any problems related to the received order.
MarcheLove.it cannot be held responsible for delivery errors resulting from inaccuracies or omissions in the customer’s order. MarcheLove.it also cannot be held liable for any damage to the products occurring after delivery to the carrier responsible for their transport, nor for delays in delivery attributable to the carrier.
The offers on this website are valid as long as the listed products remain online and while supplies last. MarcheLove.it also reserves the right to notify the customer, at the email address associated with their profile, of the unavailability of one or more of the purchased products. In the event of a purchase of a product that is no longer available, MarcheLove.it will refund the price and any shipping costs incurred by the customer (to the payment card or PayPal account used for the purchase, or via bank transfer, with details to be provided after registration).
Prices are quoted in Euros and include VAT at 22%.
The price guaranteed to the buyer is the one published on the website at the time of order submission.
Product prices are final. They do not include any shipping costs, which will be indicated in the purchase order and in the subsequent order confirmation.
The customer who wishes to proceed with the purchase of products must express this intention by placing an order directly on the website, in the dedicated section, where, following the indicated procedures, they will submit their purchase order and make the payment. Payment is due at the time of order.
The customer agrees to pay the agreed price for the ordered product on the website (including product and shipping costs) using the available payment methods. The customer guarantees to MarcheLove.it that they have any necessary authorizations to use the payment method provided at the time of the order.
If MarcheLove.it does not receive payment, it reserves the right to cancel the order. In the case of payment by credit card, MarcheLove.it reserves the right to request, within 24 hours, a copy of an identity document proving the actual ownership of the credit card used. If the requested document is not provided, MarcheLove.it may refuse the payment and cancel the order.
Payment data will be processed through a secure server-to-server connection using SSL (Secure Sockets Layer) protocol.
The transfer of risk to the customer occurs upon delivery of the products to the carrier by MarcheLove.it. During the withdrawal period referred to in Article 13, the customer is responsible for the item as its custodian. In the event of damage to or destruction of the product while in the customer’s custody, the customer will bear all consequences.
The order will be executed within the timeframes specified on the Website, upon acceptance of the order by MarcheLove.it, and in any case within 4 to 7 weeks following the order confirmation, subject to the availability of the ordered product and unless otherwise agreed between the parties. In the event of stock depletion or unavailability of the ordered product, MarcheLove.it undertakes to inform the customer as soon as possible and to specify a potential date for renewed availability. See Article 6 regarding product availability.
The geographic delivery area corresponds to the geographic scope of the offer. Deliveries are made from Monday to Friday. Products are delivered to the address provided by the customer.
MarcheLove.it, subject to the provisions of Article 6, undertakes to deliver the products to the address provided by the customer in the purchase order, through the carrier appointed for their transport. MarcheLove.it cannot be held responsible for delivery errors resulting from inaccuracies or omissions in the customer’s order. MarcheLove.it also cannot be held liable for any damage to the products occurring after delivery to the carrier, nor for delays in delivery attributable to the carrier.
MarcheLove.it delivers throughout Italy and the European Union. Deliveries to remote postal codes (e.g., Venice Lagoon) may result in variations to the shipping fees indicated. Delivery is carried out via couriers selected by MarcheLove.it, with prior notice via email, SMS, or phone; P.O. Boxes are not considered valid addresses for delivery purposes.
The delivery document issued by the carrier, dated and signed by the customer upon receipt of the product, constitutes proof of transport and handover. Upon delivery, the customer must verify the contents, conformity, and condition of the product(s). In case of delays, damage, total or partial loss, or other issues, the customer may file a claim with the carrier, without MarcheLove.it being held liable.
Therefore, upon delivery, MarcheLove.it recommends that the customer check the condition of the delivered products before signing the receipt. If any anomalies are found, the customer must refuse delivery and clearly note detailed and dated observations such as: damaged package, torn pallet/cardboard, broken package, opened or scratched wrapping. These claims must be communicated immediately to MarcheLove.it by email at [info@MarcheLove.it](mailto:info@MarcheLove.it), attaching photos of the damaged package/pallet and the delivery note with the annotation of the issue.
The customer has the right to withdraw from the Contract, without any penalty and without specifying the reason, starting from the receipt of the order confirmation sent by MarcheLove.it and no later than fourteen working days from the receipt of the product at the delivery address indicated. The date shown on the delivery note shall constitute full proof of receipt.
The customer may exercise the right of withdrawal by sending a specific communication (including the recipient’s details, order number, and date of receipt) to the following email address: [info@marchelove.it]
If the product has already been delivered, the customer is required to return it to MarcheLove.it as follows:
- The deadline for returning the product is fourteen days from the communication of withdrawal (in the case of return shipment by the customer, the customer must provide proof of shipment). For the purposes of meeting the deadline, the product is considered returned when it is handed over to the courier.
- If the product has been delivered, the substantial integrity of the item to be returned is an essential condition for exercising the right of withdrawal. The customer must ship the product properly packaged; MarcheLove.it does not accept damaged returns, but only products kept in normal condition and handled with due care. Products damaged by detergents/additives, or damaged due to customer negligence, will not be replaced or refunded. The customer must include inside the return package a copy of the return authorization received from MarcheLove.it. The risks of transport for returning the products are entirely borne by the customer.
- The costs of returning the goods to MarcheLove.it are borne by the customer. If the customer exercises the right of withdrawal in accordance with these terms and conditions of sale, MarcheLove.it will refund the amounts paid by the customer using the same payment method used for the original transaction (credit card, PayPal, bank transfer), unless otherwise indicated by the customer. The refund will be made free of charge within fourteen days from the date on which MarcheLove.it is informed of the exercise of the right of withdrawal. As provided for by Legislative Decree 6/9/2005 no. 206 and Article 55 of the Consumer Code, the right of withdrawal regulated by these terms and conditions of sale does not apply to goods made to measure or clearly personalized, or goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly.

Returns of items that are damaged, stained, washed, or not properly packaged will not be accepted.
In order to ensure high quality standards, the products undergo quality control procedures by MarcheLove.it before being shipped. All products sold benefit from the legal warranty against hidden defects as provided by Articles 1641 and following of the Civil Code.
Non-compliant products will be replaced with an identical product and sent to the customer at the expense of MarcheLove.it, except in cases of unavailability or discontinuation of the product. In the latter case, MarcheLove.it will refund the price of the product to the customer.

MarcheLove.it assumes no responsibility for any issues experienced by the customer from using the website and the technologies employed, as these are beyond its control.
MarcheLove.it informs that the website, as well as all trademarks and distinctive signs used in connection with the sale of the products offered, are protected by applicable intellectual and industrial property rights, and any form of reproduction, communication, distribution, publication, alteration, or transformation is strictly prohibited, regardless of the form or purpose. MarcheLove.it reserves the right to take legal action to protect these rights. MarcheLove.it assumes no responsibility regarding the trademarks and other distinctive signs appearing on the products sold on the website, over which the customer acquires no rights upon conclusion of the Contract.
MarcheLove.it is the data controller of the personal data collected at the time of registration on the site, as well as of the data subsequently provided when the customer makes a purchase, except for the data related to the payment procedure, which are managed by the banks through which the transaction takes place. These general terms and conditions of sale constitute the entirety of the obligations of the parties. No other general or specific condition communicated by the customer shall be included or prevail over these general terms and conditions.
If one or more provisions of these general terms and conditions are deemed invalid or declared as such under any law, regulation, or following a final decision by a competent court, the remaining provisions shall retain their full force and effect.
